  • Filing for personal Chapter 7 Bankruptcy offers a fresh financial start by discharging debts, freeing you from personal liability and shielding you from creditor collections. This process involves three primary parties: You, your dedicated attorney, and the appointed trustee overseeing your case.

    As your attorney, our foremost responsibility is safeguarding your assets, including your home and vehicle, ensuring they're protected throughout the proceedings. Trust us to navigate your Chapter 7 Bankruptcy with expertise and care.

  • We offer a $0 down option for our clients to ease the burden of filing for bankruptcy. We guide you through the process, starting with filing what’s called a “skeletal petition,” which is comprised of the Official Bankruptcy Forms, with the court. You pay no attorney fees until after your petition is filed, allowing you to focus on your financial future worry-free.

  • Prior to filing your skeletal petition, our office will assist you in gathering the necessary documents and navigating the pre-filing process. We’ll ensure you’re prepared by helping you through the required Credit Counseling Course. To finalize your Official Bankruptcy Forms, you’ll need to provide essential details such as a list of all creditors, your income, all your property, and expenses.

     

    Once your skeletal petition is filed, we will have 14 days to complete your bankruptcy filing. During this time, the trustee will request us to submit your Bankruptcy Schedules. We will work with you every step of the way with diligence and efficiency.

  • A 341 meeting, or Meeting of Creditors, is a hearing that the debtor must attend, and is conducted by the Trustee of your case. It is usually held a month after the filing of your skeletal petition. During this session, you'll provide truthful answers, under penalty of perjury, regarding your financial situation and other relevant aspects of your case. While creditors aren't mandated to attend, they're notified and may participate to inquire about associated assets.

    Conducted remotely via conference call or Zoom, our clients have the flexibility to join from the comfort of their homes or in person at our office. Rest assured, we'll stand by your side throughout, ensuring you're well-prepared and supported every step of the way.

  • Most debts incurred before the initial filing date can be discharged. A few exceptions include, but are not limited to, certain tax claims, alimony, child support, and guaranteed educational loans. To have your federal student loans considered for discharge, we would have to file a separate action during your case, called an “adversary proceeding.” This will request the court find that repayment of such loans would impose undue hardship on you and your family.
